Domain Name Dispute Arbitration. The Dispute Resolution Service DRS Policy requires Complainants to prove that they have rights in respect of a name or mark which is identical or similar to the domain name. The UDRP currently applies to all generic top level domains some country code top-level domains and some older top level domains in specific circumstances.
ADNDRC was formed by the Hong Kong International Arbitration Centre HKIAC and the China International Economic and Trade Arbitration Commission CIETAC as a result of discussions over the past year. Disputes alleged to arise from abusive registrations of domain names for example cybersquatting may be addressed by expedited administrative proceedings that the holder of trademark rights initiates by filing a complaint with an approved dispute-resolution service provider. In the event that you transfer a domain name registration to us during the pendency of a court action or arbitration such dispute shall remain subject to the domain name dispute policy of the registrar from which the domain name registration was transferred.
The dispute was initiated in terms of the Alternative Dispute Resolution Policy the Policy of the Kenya Network Information Center KENIC read together with the Trade Marks Act and the Arbitration Act.
